可转让货物单证的新文书草案实践及应用前景

现阶段，可转让运输单据在全球贸易发展中发挥着举足轻重的作用，尤其是其所有权属性可在金融服务中起到抵质押担保功能。但由于铁路等运输方式单据不具备物权属性，伴随着共建“一带一路”发展，中欧班列的应用迅速增长，产生了赋予铁路运输单据物权属性的金融需求。笔者通过对联合国国际贸易法委员会（以下简称贸法会）可转让货物单证的新文书草案（以下简称草案）的实践案例分析，对该草案后续全球推广工作提出建议。
